The Egyptian Organization for Human Rights (EOHR) welcomes the presidential pardon on Ibrahim Issa

EOHR welcomes the presidential pardon which was issued by President Hosni Mubarak yesterday on 6th  October 2008 on Ibrahim Issa , editor –in –chief of Al Dostour newspaper , after the decision issued by Bolaque Misdemeanors Court of Appeal in case No.2663-2008 registered with No.1042-2007 High State Security for  publishing false information and rumours  about Mubarak’s health by  accepting the Appeal formally and in facts by amending the appealed decision with 2 months imprisonment .

 

 The presidential pardon coincides with accusing  other 3 editors (Wael Al-Abrashi, of the weekly “Soat al-Ommah”, Adel Hamoda, of the weekly “Al-Fagr”, and Abdel Halim Kandeel, former editor of the weekly “Al-Karama“)of committing another publishing crime prosecuted by lawyers related to National Democratic Party (NDP).

 

 

It is worth noting that Issa was sentenced by a misdemeanour court for “publishing false information and rumours“ about Mubarak’s health and  he  was first indicted by the High State Security Prosecutor  on 5 September 2007, on allegations of “propagating false news and rumours causing a general security disturbance and harming the public interest” and “intentionally publishing false news that may harm public safety.” in accordance with Articles 171 and 188 of the Egyptian Penal Code . So he was submitted to Bolaque Misdemeanor court which sentenced him to 6 months imprisonment and 200 L.E fine  .  In addition , the decision was appealed and  Bolaque Misdemeanor court issued its final decision with sentencing him to 2 months imprisonment until the presidential decision issued  .

 

 

 

EOHR welcomes the presidential pardon as it confirms its demands not to apply the criminal law for punishing journalists with imprisonment as it is clear that the current laws aims at imposing strict penalties on journalists not for defending the freedom of opinion and expression .EOHR calls the Egyptian government for not applying the Penal Code to criminalize the freedom of opinion and expression and press freedom and to implement its international obligations concerned with the freedom of expression including the International Covenant on Civil and Political rights, beside to  what Article 19 of the Universal Declaration of Human Rights stipulated.

  

EOHR believes that the presidential decision is a message for the government and the legislative council to work according to it as it is reminding with the presidential promise to abolish the negative sanctions for freedoms in opinion and expression crimes .

 

 Therefore, EOHR  hopes that the Egyptian government submits a proposal for the Legislative Council to enact a law for the completion of the presidential promise to amend all articles in the Penal Code, which punished with the imprisonment in publishing cases, particularly articles 102 and 171 and 188.
