EOHR has received information that one of the smuggling gangs of migrants locked up 300 African migrants on 13-8-2010, due to the inability of those migrants to pay for their smuggling to Israel. This smuggling gang restricted 40 of the 300 Africans on 13-8-2010, inside one of the cottages located in a desert area beside the Israeli borders. One of the Africans was able to release himself, taking the gun of one of the smugglers, and randomly releasing fire against smugglers, he released 53 Africans and taking more weapons and smugglers’ munitions. Furthermore, a clash was occurred between the smugglers and the Africans, which lead to the death of 7  persons and the injury of others and the last case died on Sunday 15-8-2010.

After the escape of a huge number of Africans from  smugglers, a group of them tried to reach barbed wire border that separates Egypt from Israel in order to sneak to Israel, but the Egyptian security forces dealt with them them. Two of  Africans  were killed by the police, one of them killed in front of the international sign number 7 and was Transferred to Sheikh Zuwaid’s morgue and the other one was killed in front of (international sign number 8) 8 km south Rafah crossing.

Mr. Hafez Abu Seada, chairman of EOHR, has called for the  immediate investigation on the death and assault facts of  the African migrants and deliver perpetrators to justice. He called for  the necessity of the intervention of the Egyptian authorities to release all migrants. He stressed on the importance of putting an end to the policy of shooting migrants, and to investigate in all committed violations related to migrants, refugees and asylum-seekers and giving effects to the principle of combating  impunity, and to put the provisions of the law against trafficking in action, as well as the International Convention for the Protection of Refugees in 1951 through the enactment of legislation that legalizes  their conditions in Egypt.

Abu Seada recommends the government to the need to join
the international and regional conventions that confronts the  Transnational Organized Crime, and in particular the United Nations Convention against Transnational Organized Crime, adopted by the Conference in Palermo, Italy, in December 2000, and its additional Optional Protocol to prevent, suppress and punish trafficking in persons, especially women and children, and  the Optional Protocol against the smuggling of migrants through land, sea and air.
