The Egyptian Administrative Court Suspends the Constitutional Assembly

of the appeals filed by a number of famous activists and lawyers including; Mr. Hafez Abu Seada, attorney at law & the Chairman of EOHR, Prof. Gaber Nassar, Professor of Criminal Law at The Egyptian Administrative court, in its rule today, has suspended the constitutional assembly elected by the parliament. Where, the administrative court, on the 10th of April 2012, has ruled in favor Cairo University and Shehata Mohammed Shehata, the lawyer.

The Administrative Court declared in the text of the judgment that it “decided to suspend the decision of forming the constitutional assembly”, as well as accepting the challenge presented to it, considering the recent formation of the constitutional assembly, which 50% of its members was elected from the members of the People’s assembly and Shura Council, as “a wrong administrative decision, tainted by erroneous deviation in the use of power.”  The court’s decision also includes the referring of the case to the “Board of State Commissioners” for the preparation of the report of the legal opinion in the case.

It is worth mentioning that EOHR filed this case, No. 26954 for the year 2012, in front of the Administrative court, submitted by Mr. Hafez Abu Seada, against the head of the Supreme Council of Armed Forces (SCAF), and the heads of both the People’s Assembly and Shura Council, challenging the invalidity of the constitutional assembly with its recent structure, as this structure shall prohibit the right of many other sections of the Egyptian community as; political forces, legal experts and scholars of constitutional law, to share in drawing up their constitution and their future.
